Terms of Use

These Terms and Conditions (“Terms”) govern your use of the website [backstageplus.io] (“Site”) and the Backstage+ platform. By accessing or using our services, you agree to these Terms.

1. About Backstage+

Backstage+ enables fans to purchase exclusive, behind-the-scenes content from live music tours (rehearsal footage, backstage clips, voice notes, and more) shared directly by artists and their teams.

Access to content is sold on a per-show, one-time basis. There are no subscriptions or recurring charges.

2. Fan Usage Terms

2.1 Content Access

When you purchase Backstage+ access to a tour, you receive non-transferable, personal streaming access to that specific tour’s content.

You agree not to:

Share or repost content publicly

Download or distribute content outside of the platform

Use any content commercially or modify it

2.2 Payments & Refunds

All payments are processed securely via Stripe. Because content is digital and access is granted immediately upon purchase, all sales are final. We do not offer refunds unless access is not delivered due to a technical error.

2.3 Fan–Artist Transactions

When you purchase access to an artist’s content on Backstage+, your transaction is a direct agreement between you (the fan) and the artist providing the content. Backstage+ facilitates payment and delivery of content through the platform, but we are not a party to the agreement between you and the artist.

Artists are solely responsible for the content they provide, including its quality, accuracy, and compliance with these Terms and applicable laws. If you have concerns about specific content, you may contact Backstage+ support for assistance, but any obligations, disputes, or claims relating to that content remain between you and the artist.

2.4 Platform Rules

In addition to Section 2.1 Content Access, fans must follow these Platform Rules to help keep Backstage+ safe and respectful.

You agree not to:

Harass, threaten, or abuse artists, their teams, or other fans.

Post or transmit hateful, discriminatory, or abusive messages through any Backstage+ features.

Engage in deceptive or fraudulent activity (e.g., scams, impersonation, unauthorized account access).

Circumvent security measures or attempt to interfere with the platform’s operation.

Use Backstage+ for any unlawful purpose.

Backstage+ may suspend or terminate accounts that violate these rules.

3. Artist Terms

This section applies to any artist, manager, or team participating in Backstage+.

3.1 Content Ownership

You retain full ownership of all content you upload or share with Backstage+. By submitting content, you grant Backstage+ a license to:

Host and deliver content to fans

Promote the content within the platform and via direct communications (e.g. emails to fans)

We will never resell, repurpose, or distribute your content beyond the agreed-upon fan access model.

3.2 Uploads & Usage

Artists submit content via a private upload folder and optional onboarding forms. You agree that:

All content is original and owned or licensed by you

The content shared is appropriate for a general audience and does not infringe on third-party rights

Backstage+ may lightly edit or format content (e.g. thumbnails, title formatting) but will never alter the creative intent

3.3 Platform Rules

In addition to Section 3.2 Uploads & Usage, artists and their teams must follow these Platform Rules when uploading or sharing content on Backstage+.

You may not upload or distribute content that contains:

Sexual content: Pornography, sexually explicit material, or sexual themes involving non-consensual activity or minors.

Violent or dangerous content: Content that incites violence, promotes terrorism, self-harm, suicide, animal cruelty, or depicts graphic violence.

Hateful or abusive content: Content targeting or harassing individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.

Deceptive or scam content: Content intended to mislead, defraud, or impersonate.

Infringing or illegal content: Content that violates copyright, trademark, privacy, or other rights, or that otherwise breaks the law.

Backstage+ may remove or restrict access to content that violates these rules, and serious or repeated violations may result in account suspension, termination, or withheld payouts.

3.4 Revenue Share

Artists receive up to eighty percent (80%) of Net Revenue generated from fan purchases of their content.

For purposes of these Terms, “Net Revenue” means the gross amount actually received by Backstage+ from fan purchases, less (i) third-party payment processing fees, transaction costs, or platform service fees; (ii) refunds, reversals, or chargebacks; and (iii) any applicable sales, VAT, or similar taxes collected or remitted.

Revenue shares and payouts are handled securely and tracked through our Lemon Squeezy integration and internal records. Terms may vary by artist tier and will be agreed upon during onboarding.

If a fan payment is refunded, reversed, or charged back by a payment provider, Backstage+ may deduct an equivalent amount from your future payouts or withhold such amounts until the matter is resolved.

3.5 Payouts

Payouts to Artists are made within thirty (30) days of the end of each calendar month in which Net Revenue is earned, provided the total amount due is at least twenty U.S. dollars (US$20). Balances under this threshold will roll over to the next payout cycle until the minimum amount is reached.

All payouts are made via PayPal, Wise, or another method reasonably designated by Backstage+. You are responsible for ensuring that your payment details are accurate and up to date. Backstage+ is not responsible for delays, failed transfers, or losses resulting from incomplete or incorrect payment information supplied by you.

Backstage+ reserves the right to withhold or delay payouts if:

A payment is subject to refund, reversal, or chargeback;

There is a dispute, investigation, or suspected violation of these Terms; or

Backstage+ reasonably determines that withholding is necessary to comply with applicable laws or protect the integrity of the platform.

If your participation in Backstage+ is terminated, you will remain entitled to receive any Net Revenue accrued prior to the termination date, subject to the standard payout schedule and any applicable deductions or withholdings.

3.6 Liability & Indemnification

You are solely responsible for the content you upload or share through Backstage+. You represent and warrant that you have all rights, licenses, and permissions necessary to make your content available on the platform.

You agree to indemnify, defend, and hold harmless Backstage+, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

Your content, including any allegation that it infringes or violates the rights of a third party

Your breach of these Terms

Your misuse of the Backstage+ platform

Backstage+ provides the platform “as is” and disclaims all warranties, express or implied, to the fullest extent permitted by law. To the extent Backstage+ is found liable, our total liability to you for any claim arising out of or related to these Terms will be limited to the greater of (i) one hundred (100) U.S. dollars or (ii) the total amount paid to you by Backstage+ in the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms limits or excludes any liability that cannot be excluded by law.

3.7 Fan-Artist Transactions

Backstage+ facilitates transactions between fans and artists by providing access to the platform and handling payments. However, Backstage+ is not a party to any agreement between you (the artist) and a fan.

All content access purchased by fans constitutes a direct agreement between the fan and the artist. You are solely responsible for fulfilling the fan’s access to the content you provide, and for ensuring that such content complies with these Terms and all applicable laws.

Fans may raise issues through Backstage+ support for administrative assistance, but Backstage+ does not assume liability for any dispute, claim, or obligation arising out of the relationship between a fan and an artist.

3.8 Termination

Backstage+ reserves the right to suspend or terminate your account and remove any content at any time if you breach these Terms, if your content is alleged to infringe the rights of others, or if your participation is deemed to pose a risk to the platform, its users, or its reputation.

You may terminate your participation in Backstage+ at any time by providing written notice to artists@backstageplus.io. Termination will not affect your entitlement to any revenue already accrued but unpaid, subject to applicable payment schedules and deductions.

Upon termination, all licenses granted to Backstage+ under these Terms will cease, except that Backstage+ may retain backup copies of content as required by law or for legitimate business purposes (e.g., audit, dispute resolution).

Backstage+ may also remove or disable access to specific content at any time if it believes the content breaches these Terms, applicable law, or poses a risk to the platform, its users, or its reputation.

3.9 Tax Compliance

You are solely responsible for reporting, collecting, and paying all applicable taxes on revenue you receive through Backstage+. Backstage+ does not provide tax advice and is not responsible for your tax obligations. We may provide general guidance or information, but it should not be relied on as legal or tax advice.

We collect limited personal information (such as emails, names, and payment info) to operate Backstage+. See our Privacy Policy for full details.

5. Platform Limitations

Backstage+ is currently in MVP stage. While we aim for consistent quality and uptime, we do not guarantee:

Uninterrupted access or availability of all content

Compatibility with all devices or browsers

6. Modifications to Terms

We may revise these Terms from time to time. The updated version will always be posted on our site. We may also notify you of material changes by email or in-platform message, but it is your responsibility to review the Terms regularly. Continued use of the platform indicates your agreement to the new Terms.

8. Governing Law & Jurisdiction

For Fans (Consumers):
If you are a consumer located in the United Kingdom, these Terms are governed by the laws of England and Wales, and the courts of England and Wales shall have jurisdiction over any dispute. If you are a consumer located in the United States, these Terms are governed by the laws of the State of Delaware, and any disputes shall be resolved in the state or federal courts located in Delaware. If you reside elsewhere, you may also rely on mandatory protections under the law of your home country, but to the extent permitted, disputes will be resolved under the laws and courts specified above.

For Artists & Business Users:
If you participate in Backstage+ as an artist, manager, or business user, these Terms are governed by the laws of the State of Delaware, USA, and any disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware. However, if you are based in the United Kingdom or European Union, Backstage+ may elect to bring proceedings in the courts of England and Wales.
